Comunitarismo platônico: a República e o direito natural

Abstract

Este trabalho sustenta que a República de Platão não apresenta uma teoria do direito natural, mas antes uma defesa do comunitarismo. Ele introduz as diretrizes gerais da teoria moderna do direito natural, opondo-as às explicações teleológicas antigas. Em sua seção central, ele se dedica às três passagens consideradas como argumentos em defesa do direito natural: o desafio de Gláucon, a fundação da cidade e a função normativa do bem. As análises atestam que esses argumentos não correspondem ao padrão básico do direito natural moderno, e que, ao invés, eles se encaixam muito melhor no que hoje é chamado de abordagem comunitarista. Em sua última parte, o trabalho mostra como alguns problemas atribuídos às teorias comunitaristas também podem ser imputados à República.

This paper claims that Plato’s Republic does not present a theory of natural right, but rather a defense of communitarianism. It introduces the general outlines of the modern natural right theory, opposing them to the ancient teleological explanations. In its central section, it addresses the three passages considered to be arguments in defense of natural right: Glaucon’s challenge; the foundation of the city and the normative function of the good. The analyzes attest that these arguments do not correspond to the basic pattern of modern natural right, and that they instead fit much better to what is called today a communitarian approach. In its last part, the paper shows how some problems ascribed to communitarian theories can also be assigned to the Republic.
