De Liberales Y Liberalismos En El Orbe Hispánico (Una Reflexión Historiográfica Sobre La Naturaleza Del Poder Constituyente Gaditano: 1808-1812)

Abstract

El presente artículo cuestiona la pertinencia del uso del término liberal a la hora de calificar la obra constitucional doceañista, la cual, a su vez, se contempla como una de las versiones del constitucionalismo hispánico que vio la luz tras la crisis de la Monarquía de España en 1808. A estos efectos, valora la fundamentación historicista de dicho constitucionalismo, centrándose en concreto en el análisis de las limitaciones asumidas por las Cortes Generales y Extraordinarias en virtud del juramento prestado en el mismo momento de su constitución como representación de la Nación soberana.

This article challenges the appropriateness of the term «liberal» when dealing with the Cádiz Constitution of 1812, underlying the fact that this document was one of the results of the «hispanic constitutionalism» that had emerged after the crisis of the Monarchy in 1808. For that purpose, the historical foundations of this constitutional model are analysed, focusing in particular on the study of the limitations assumed by the Cortes Generales y Extraordinarias by means of the oath taken at the very moment of its establishment as the representative body of the Nation.
