A ermida do Espirito Santo da Ericeira e a criação da Misericordia: identidade e autoridade num conflito de espaços

Abstract

Tendo-se já presentemente um conhecimento profundo sobre os moldes de constituição das Santas Casas, pretende-se com este estudo perceber a especificidade de estabelecimento dessa irmandade na Ericeira, num tempo além do designado «Século das Misericórdias», por contrato firmado entre o benemérito Francisco Lopes Franco e os pescadores da vila. Entre a fundação e a efectiva actividade da Misericórdia têm-se trinta e sete anos, correspondentes à edificação da Santa Casa na ermida do Espírito Santo e a um longo processo de disputa de direitos entre a recém-criada irmandade e o prior de S. Pedro que tem por base o local de sitiamento da confraria e que se prolongará, à medida que a Misericórdia reforça a sua posição. O teor e as alegações da questão judicial estudada merecem consideração pela exemplaridade das relações entre a Coroa e a Igreja na época em foco.

Considering that there is already considerable knowledge about the founding of Santas Casas, this study focus specifically on the confraternity of Ericeira and on a signed agreement between the benefactor Francisco Lopes Franco and the fishermen of the town, in a time beyond the so called “century of the Misericórdias”. Thirty-seven years passed between the founding and the functioning of the Misericórdia. These years correspond to the formation of the Santa Casa in the chapel of the Holy Spirit and a lengthy discussion of rights between the newly formed confraternity and the priest of St. Peter’s based on the confraternity foundation place, whilst the Misericórdia was enforcing its position. The wording and allegations of the studied legal proceedings deserve consideration as an example of the relations between Crown and Church at the time.
